RSFT COVID-19 PathEKS Privacy Notice

Royal Surrey NHS Foundation Trust supplementary privacy notice on PathEKS Lateral Flow System for RSFT staff. (March 2021)

Purposes for processing

To support the efforts of the NHS and Public Health England in the management and containment of a global pandemic.

To provide RSFT with a staff self-reporting digital platform to submit the outcome of their Lateral Flow tests for CORONA virus and immunisation status of a notifiable disease. Individuals registered are required to routinely test and submit results to the EKS Lateral Flow System.

Data collection and categories

To provide a centralised data collection for lateral flow testing Department of Health & Social Care has contracted a third party to provide an online application PathEKS to support the reporting. Data is stored in a secure accredited environment in the U.K. which will only be accessed and processed by authorised staff that have explicit and reasonable need to do so.


The Trust is mandated to share named data with regulatory bodies such as Health & Safety Executive or Public Health England. This will include the following data, collected at time of the individual signing consent to provide twice weekly returns: name, gender, DOB, NHS number, address or residence, postcode, email address, mobile number, ethnicity, date of tests performed, serial number of test strip, result – recorded as positive, negative and invalid.


The contact information supplied by an individual will only be used in the event of a positive test result by Public Health England and the track & trace service for following up cases (contact will be made via the email address used to create a PathEKS account so an individual should consider whether they would like to use a work or personal email). Gender and ethnicity will be used by Public Health England for research purposes to help to identify variants in specific groups of people, though an individual can choose not to disclose this information.

The Trust Occupational Health service will retain information as part of an individual’s OH record and for the duration employment.

Anonymised data may be used by the Trust for research, clinical audit or service evaluation purposes. No individual will be identified in this data.
